Uber & Lyft Drivers Now Covered for Workers’ Comp Injuries
Good news for Uber and Lyft drivers! On December 20, 2019, New York State mandated Workers’ Compensation coverage for all Uber and Lyft drivers injured in the course of providing a prearranged trip to a customer. These drivers were deemed to be employees of the New York Black Car Operators’ Injury Compensation Fund.
Interestingly, this coverage extends beyond drivers injured while engaged in a prearranged trip. It also covers logged-in Uber and Lyft drivers who are not engaged in a prearranged trip but are engaged in an activity that is reasonably related to such a trip. For instance, filling up your gas tank while logged in and awaiting dispatch would likely be covered.
